HEMA Act 3.9.-21

On the legal regulation regarding the sale of cosmetic products starting from September 3, 2021

The EU Chemicals and Safety Commission has tightened regulations on chemicals to protect consumer health.

In the future, all products that contain

  • 2-hydroxyethyl methacrylate (HEMA); and
  • 11,14-dioxa-2,9-diazaheptadec-16-enoic acid, 4,4,6,16-tetramethyl-10,15-dioxo,2-[(2-methyl-1-oxo-2-propenyl)oxy]ethyl Ester (Di-HEMA trimethylhexyl dicarbamate or Di-HEMA TMHDC).

ingredients, are restricted to professional use only. It should be noted, however, that products containing these ingredients are safe for consumers when used correctly. TUKES (Finnish Safety and Chemicals Agency) defines a professional as a person who is trained to know and use products correctly that can lead to allergies or be harmful to health if misused. It is also possible to become allergic to these chemicals, even if the products have been used correctly. All substances can lead to sensitization, regardless of the person.

Allergies to these chemicals are permanent and sensitivity to harmful chemicals does not diminish over time. Once an individual is allergic to these chemicals, they are also allergic to all other products that contain these substances.

The most well-known nail products that may contain these chemicals are the traditional acrylic system, building gels, and gel polishes.

The change will enter into force on 3 September 2021. EU legislation applies to products manufactured and sold within the EU. For products from outside the EU and EEA countries, the consumer is responsible for the safety of the chemicals themselves.
